Nicholas Taliercio

Nicholas Taliercio’s criminal practice is focused on defending individuals accused of felonies or misdemeanors in state or federal courts in New York. His experience includes defending individuals accused of RICO and RICO conspiracy, firearms violations, drug possession, drug distribution, conspiracy, extortion, cryptocurrency-related fraud, sex offenses, and white-collar offenses. Mr. Taliercio has experience in sentencing litigation under the federal sentencing guidelines as well as obtaining modifications of sex offender registration (SORA).

Nick’s expertise in navigating, organizing, and understanding large amounts of data in complex criminal cases has led him to provide assistance to members of the Criminal Justice Act Panel for the Eastern and Southern Districts of New York, where he defends indigent clients charged with federal crimes in complex multi-defendant prosecutions.

Nicholas Taliercio is admitted to practice in New York and New Jersey, as well as the United States District Courts for the Eastern and Southern Districts of New York.

Representative Criminal Defense and Sentencing Matters

Our attorney, Nicholas Taliercio, was trained under founding partner Lloyd Epstein, a pioneering attorney known for his strategic and innovative use of sentencing guidelines to achieve favorable outcomes for his clients. Mr. Taliciero brings that same sharp, client-focused approach to criminal defense through Epstein & Weil, handling trials involving federal charges, narcotics, internet crimes, weapons offenses, white collar crimes, and violent felonies.
Multiple Federal Racketeering Conspiracy (RICO) cases, including extortion, narcotics, narcotics distribution, and firearms. Jury acquittal on multiple counts.
Federal Wire Fraud and Money Laundering related to Bitcoin. After replacing prior counsel who had negotiated a plea and sentence of 121-151 months, he renegotiated a plea agreement to a lower agreed-upon guideline sentence of 87 – 108 months.
VICAR/Firearms charges {Violence in Aid of Racketeering, 18 U.S.C. §1959(a)}. Successfully challenged the prosecution’s reliance on New York’s menacing statute as the required underlying predicate and obtained jury acquittals on those counts.
Jury Trial of RICO involving multiple counts, including drug distribution and use of firearms in furtherance of the conspiracy, with a potential sentence of 25 to life. Jury acquittal of drug dealing, delay of sentencing pending determination of United States v. Davis, 588 U.S. 445 (2019), which resulted in vacatur (tossing out) the firearms count. The client’s sentence was commuted to probation during COVID, and is now completed in 2025.
Death penalty eligible offenses: participated in a team submission that persuaded the DOJ not to seek the death penalty. Nick Taliercio negotiated a plea agreement with a sentence of a term of years, not life.
Multiple gang-related shootings. Litigation demonstrating the prosecution’s improper compliance with discovery resulted in a plea offer 60% shorter than that offered before the forced evidence turnover.
First Degree Rape, facing a potential multi-decade sentence. Negotiated a settlement that avoided both a felony conviction and sex offender registration with a sentence of time served.
Bribery, blackmail, and misprision of a felony. The jury acquitted on all three counts.
Healthcare Fraud, submission of thousands of dollars of fraudulent invoices. After a significant investigation into mitigating circumstances, Nick Taliercio negotiated a plea of restitution and probation.
